A Special Request from Retired MPD Officer Andy Garcia

Hi gang, attached are 3 documents sent to me by retired MPD officer Andy Garcia. He is asking that people take a look at the documents and if you agree with what he and his family are asking, then send the one form to the DA. The board looked at these and felt that we would have no problem sending a similar letter (which I have already done) to the DA as our union president. We do not feel that this letter is negative towards the DA or his office, it merely asks that the DA put the case before a judge and or jury and let them decide what is a proper sentence.

For some background for those who do not know Andy or what happened last year: As the one document states, Andy retired after he had been shot in the leg while on duty in 1999. His 19 year old daughter was killed in an auto accident last year on May 15th (law enforcement memorial day). The driver of the car she was in was in the right hand lane of hwy 51 and that lane was about to end. He chose to speed up (Deputies I have talked to have said the speed was est. to be close to 100 mph) and continue passing cars on the right instead of merging. He lost control eventually and swerved into oncoming traffic and hit another car coming the opposite direction. The driver killed Andy's daughter, and easily could have killed 3 others (his other passenger and the two people in the other car he hit). Fortunately they all lived but did have severe injuries. Andy has been talking to the DA's office and as his letter states, they chose to charge a lesser charge but still one that carries a maximum sentence of 10 years in prison. He is now hearing that the DA's office is considering a plea for the driver for probation only with no jail or prison time. He is asking that you look at the letter and if you agree, send it (I am asking that if you send it, don't use departmental mail, use your personal mail).

Thanks for your consideration,
Dan Frei
